Rob Heyman captured this footage of rats running rampant at the Green Egg’s Cafe in Philadelphia. The owner states that a broken sewer line caused the infestation. The situation has since been remedied. Sometimes situations like this can morph into legal action. For example, if a frequent customer of Green Egg’s Cafe came into my office and had been diagnosed with Lymphocytic Choriomeningitis (LCMV), a viral infections disease that is transmitted through the saliva and urine of rats, then our firm would consider a lawsuit.
Here, it would be difficult to sue Green Egg’s Cafe for damages, even if a regular customer contracted a rat-borne illness. The Plaintiff is required to prove causation in every negligence action. An attorney would have to show beyond a preponderance of the evidence, that “but for” their client’s frequenting of Green Egg’s they would not have contracted the illness. A defense lawyer would almost certainly argue that the healthy rat population in Philadelphia means the illness could have been contracted anywhere.
